Melvin Guillard survives Jamie Varner slam but loses UFC 155 bout

Melvin Guillard and Jamie Varner staked a late claim to the UFC 155 Fight of the Night bonus with a bout that ended in a split decision. Varner won it on the judges' cards, 30-27, 27-30, 29-28.

Varner gained an edge early in the bout by tagging Guillard in the first round. Guillard showed good kicks, but couldn't escape Varner's takedowns for much of the bout. But the most frightening moment of the bout came late in the third round.

The two were scrambling on the ground for position when Guillard took Varner's back. Varner stood up, and with Guillard's head pointed to the ground, Varner slammed his opponent to the ground. Amazingly, Guillard was not knocked out or injured from the move. The fight ended seconds after, and the two embraced.

?This was a very emotional fight for both of us," Varner said after the bout. "After what happened a few weeks ago at the "TUF Finale" event, we were both ready to compete. I knew we would eventually get in the Octagon and squash our beef and I definitely feel that we did. I?m happy about my performance, I feel that I was able to dominate the fight wherever we ended up and I?m glad I got the win.?

Varner and Guillard were originally scheduled to fight during "The Ultimate Fighter" finale on Dec. 15, but illness kept Varner from the cage. Guillard was understandably upset about the delay, leading to trash talk.

(AP) ? Former President George H.W. Bush will spend Christmas with his wife and other family members in a Houston hospital after developing a fever and weakness following a monthlong, bronchitis-like cough, his spokesman said Monday.

A hospital spokesman had said the 88-year-old ex-president would be released in time to spend the holiday at home, but that changed after Bush developed a fever.

"He's had a few setbacks. Late last week, he had a few low-energy days followed by a low-grade fever," Jim McGrath, Bush's spokesman in Houston, told The Associated Press. "Doctors still say they are cautiously optimistic, but every time they get over one thing, another thing pops up."

He said the cough that initially brought Bush to the hospital on Nov. 23 is now evident only about once a day, and the fever appears to be under control, although doctors are still working to get the right balance in Bush's medications. No discharge date has been set.

"Given his current condition, doctors just want to hang on to him," McGrath said, adding that he didn't know what had caused the fever.

Bush's wife, Barbara; his son, Neil, and Neil's wife, Maria, are expected to visit on Christmas, McGrath said.

Since he was hospitalized, Bush has been visited by many of his children and grandchildren, including former President George W. Bush, who came twice, and former Florida Gov. Jeb Bush, McGrath said. With 37 members in the immediate family, Bush has received many emails and phone calls, McGrath said.

Bush, the nation's 41st president, and his wife, Barbara, live in Houston during the winter and spend their summers in a home in Kennebunkport, Maine.

The former president was a naval aviator in World War II ? at one point the youngest in the Navy ? and was shot down over the Pacific. He achieved notoriety in retirement for skydiving on at least three of his birthdays since leaving the White House in 1992.

Being in the hospital for such a long time has not been easy for Bush, who is accustomed to being active, McGrath said. But the president has said he's determined "not to get grumpy about it."

"He's just the most relentlessly positive person," McGrath said, and "he does enjoy joking with the nurses."

LOS GATOS (CBS/AP) ? Those hoping to spend the holiday watching streaming video from Netflix can now get back in front of their TVs, tablets and PCs after a Christmas Eve outage.

A Netflix Inc. spokesman said by email Tuesday morning that the service has been fully restored.

The outage affected customers in the Americas starting around 12:30 p.m. PST on Monday. The company, which is based in Los Gatos, Calif., blames problems with Amazon Web Services, and says it is investigating further.

Amazon Web Services provides companies with online storage and computing. It is separate from Seattle-based Amazon.com Inc.?s better-known shopping website.

Amazon says that problems with its service have also now been fixed.

Fiscal Fail: Government Agencies Plan Few Significant Changes For January, Despite Cliff Hype

WASHINGTON - On Jan. 1, 2000, the world awoke to find that little had changed since the night before. After years of hype around what was then called Y2K -- the fear that computer systems across the globe would collapse, unable to handle the year shifting from '99 to '00 -- the date change turned out to be a momentous non-event.

Next week, the United States is in for much the same, after months of frantic hype about the economic disruption that awaits if Congress and the president fail to reach a deal and the federal government goes "over the fiscal cliff."

The so-called fiscal cliff is a combination of automatic tax hikes and spending cuts scheduled to go into effect Jan. 1. But the agencies responsible for implementing those changes, including the IRS and the Pentagon, are well aware that congressional and White House negotiators will most likely come to some sort of deal within weeks or months -- and so they are planning to carry on as usual, according to a broad review of private and public government plans.

In other words, there will be no cliff. There won't even be a slope. Congress and the president can have their public and private dramas, but the government officials responsible for carrying out their eventual orders have seen this movie before, and they know how it ends.

An IRS spokesperson said the agency is not commenting on possible fiscal cliff consequences beyond a letter it sent to Congress last week. That letter's purpose was to inform lawmakers just how many taxpayers would see higher tax bills if the alternative minimum tax (AMT) isn't patched. But the letter also holds clues to the agency's broader plans -- or lack thereof. The IRS told lawmakers it would not reprogram its system to account for the possibility the AMT would not be patched because "if Congress were to act at some point next year to enact a new AMT patch, the time and substantial expense necessary for the IRS to reprogram its systems ... would ultimately be wasted."

The IRS also isn't commenting on how it will handle tax withholding from paychecks in the new year, but if it uses the same reasoning it has applied to the AMT, there is no reason to believe the agency will reprogram all its computers to begin immediately withholding higher amounts come January. Such an effort would be wasted if Congress ends up extending tax cuts for those making less than $250,000, as it is broadly expected to do, even by House Republicans.

The IRS might be able to move more quickly on the end of the payroll tax holiday, which both parties have signaled they will let expire. But even if the IRS can immediately implement a payroll tax hike, and employers can instantly begin witholding at higher rates, a person making $50,000 a year will see $40 or so less in his or her first paycheck of 2013.

Other agencies are planning to do just as little as the IRS to prepare for a fall off the fiscal cliff. On Friday, Defense Secretary Leon Panetta assured his personnel that nothing would change come January, saying that no layoffs would be announced in the near future, nor would any be announced without extensive advance notice.

The Government Accountability Office, charged with overseeing other government agencies, itself is not planning any January changes. Instead, the GAO is backloading any possible cuts toward the end of the fiscal year in June and assuming a deal will be reached before then, according to a source at the agency who isn't involved with the press operation.

Energy Secretary Steven Chu also said no immediate cuts are in the works, though he did not rule out future furloughs. "I do not expect our day-to-day operations to change dramatically on or immediately after January 2, should sequestration occur," Chu wrote in an email to staff on Thursday. "This means that we will not be executing any immediate personnel actions, such as furloughs, on that date."

On Thursday, the Environmental Protection Agency sent out a memo that read almost identically to Chu's, and Health and Human Services Secretary Kathleen Sebelius also told her staff not to worry about department operations come January, according to a staffer there. At the Federal Trade Commission, workers were told the same. "I hope all of you have heard reassurances from your supervisors that, should the Congress and White House fail to avoid the 'fiscal cliff' triggers on January 1, the FTC will remain fully able to meet its payroll and support its mission. We have planned for this contingency and you should continue to do your work and not worry," reads a memo sent to employees.

Much like government workers, for the vast majority of the population, life on the other side of the cliff will be no different than life on this side. Those most likely to get hit, however, are the jobless, who would see unemployment benefits cut off. (They would be eligible for back benefits once a deal is cut.)

The most substantial fiscal cliff pain, then, will likely be felt by House Republicans. Indiana Rep. Dan Burton, a strongly conservative Republican, laid out on Thursday what has increasingly become conventional wisdom across party lines.

"If we go over the fiscal cliff, the president just comes back and says, 'OK, we're going to give tax cuts to everybody under $250,000.' Who's going to vote against that? Everybody'll vote for that. Everybody," Burton told reporters in the Capitol. "Because it will be just a fait accompli. You won't be voting on whether you're going to do away with a tax cut, you're going to be reimposing tax cuts for everybody under $250,000. So the Republicans are in an untenable situation."

Obama nominates John Kerry as next secretary of state

WASHINGTON (Reuters) - President Barack Obama on Friday nominated John Kerry to replace Hillary Clinton as secretary of state, calling the veteran U.S. senator the "perfect choice" for America's top diplomat as he began reshaping his national security team for a second term.

Obama settled on Kerry, chairman of the Senate Foreign Relations Committee and the 2004 Democratic presidential candidate, after the front-runner, U.N. Ambassador Susan Rice, withdrew from consideration last week.

Even as Obama put one important piece of his revamped Cabinet in place, he held off on naming a new defense secretary. The delay came in the face of a growing backlash from critics of former Republican Senator Chuck Hagel, who is considered a leading candidate to replace Leon Panetta at the Pentagon.

With Kerry standing at his side, Obama expressed confidence that the senator - a stalwart supporter who has long coveted the State Department job - would win swift confirmation from his Senate colleagues.

"As we turn the page on a decade of war, he understands that we've got to harness all elements of American power and ensure that they're working together," Obama said. "John's earned the respect and confidence of leaders around the world. He is not going to need a lot of on-the-job training."

The announcement fell short of the White House's earlier hopes of rolling out national security appointments, including a new CIA director, all at once before Christmas. That ambition was thwarted not only by the Hagel controversy but other matters that have occupied Obama's attention - the standoff over the "fiscal cliff" and last week's Newtown gun massacre.

Kerry, 69, will take over from Clinton, who has been consistently rated as the most popular member of the president's Cabinet.

But he will also have to pick up the pieces after a scathing official inquiry found serious security lapses by the State Department in the deadly September 11 attack on the U.S. diplomatic mission in Benghazi, Libya - a report that has tarnished the final days of Clinton's tenure.

Kerry's nomination follows a political firestorm that engulfed Rice, seen as the early favorite for the State job, spearheaded by Republicans fiercely critical of her role in the administration's early explanations for the Benghazi assault.

Rice was defended by Obama, but she said on December 13 she was pulling her name from consideration to avoid a potentially lengthy and disruptive confirmation process.

Kerry, known for his role as a Democratic power broker in the Senate, offers no such challenges.

His selection sets a pragmatic tone as Obama begins overhauling his national security team.

Kerry will be the leading Cabinet member charged with tackling pressing global challenges, ranging from upheaval in the Middle East to Iran's nuclear standoff with the West and winding down the war in Afghanistan - all at a time of fiscal austerity at home.

SUBDUED NOMINATION ANNOUNCEMENT

Obama appeared subdued as he announced the nomination. He and Kerry had just returned from a funeral service for Hawaii Senator Daniel Inouye at the National Cathedral.

Kerry looked on intently as Obama spoke, nodding occasionally. But the lawmaker known for sometimes long-winded speeches was not given a chance to address reporters at the White House. Clinton was absent due to illness but issued a statement saying Kerry would offer the "highest caliber leadership" at the State Department.

Kerry, a decorated Vietnam War veteran, has forged a close working relationship with Obama and gave him the keynote speech assignment at the 2004 Democratic convention that boosted a then little-known Illinois state legislator onto the national stage, opening the way for his meteoric rise.

After losing narrowly to Republican George W. Bush in the 2004 presidential election, Kerry forged a new identity as a congressional leader on foreign policy. He often served as a low-profile emissary and diplomatic troubleshooter for the Obama White House in places like Afghanistan, Pakistan and Syria.

Kerry played the role of Mitt Romney in Obama's debate practice during the 2012 campaign, and afterwards Kerry joked that he would need an "exorcism" to get the Republican out of his system. "Nothing brings two people closer together than weeks of debate prep," Obama quipped to reporters on Friday.

White House aides acknowledge, however, that Kerry does not have as close of a personal bond with Obama as Rice has. She said, in a message on Twitter, that she looked forward to "working with him on the president's national security team."

Kerry's departure from the Senate forces Democrats to defend his seat, where the party has only a slim majority. Just-defeated Massachusetts Republican Senator Scott Brown, who took office in early 2010 after winning the last special election for a Massachusetts seat, is widely expected to run.

The drumbeat of criticism against Hagel, a moderate Republican who has often broken with his party's views, could prompt Obama to reconsider whether it would be worth the likely confirmation fight if he were to chose him for the defense post.

The administration has given no sign of dropping Hagel from the short list. On Thursday it joined allies rallying to support him against an onslaught over his record on Israel and Iran led by some pro-Israel groups and neo-conservatives, but the attacks have also come from some former colleagues on Capitol Hill.

He has also come under fire from gay rights groups for remarks questioning whether an "openly aggressively gay" nominee could be an effective U.S. ambassador. Hagel issued an apology on Friday for the 1998 comment, saying it was "insensitive."

It is the second time since Obama's re-election that the White House has had to defend a Cabinet candidate who has yet to be nominated, a source of frustration for his advisers.

Also in the mix for the Pentagon job are Michele Flournoy, a former undersecretary of defense for policy, and Ashton Carter, the current deputy defense secretary.

The top candidates for CIA director, to replace David Petraeus who stepped down over an extramarital affair, are thought to be Michael Morell, currently acting CIA director, and John Brennan, a top counterterrorism adviser to Obama and a former CIA official.

Investing in high-end condominiums is considered one sure-fire way to make great returns. However, given its risk appetite, it might not be suitable for everyone.

?It?s a very niche form of investment and ideally for the super rich or those with good spending power,? notes Standard Financial Planner Sdn Bhd?s Jeremy Tan.

A good investment?

According to Malaysian Institute of Estate Agents (MIEA) president Nixon Paul, a high-end apartment is more than just about premium pricing.

?It?s more than just about the interior. The criteria for a high-end condominium is defined based on its location, the finishes, managements fees and amenities that comes with it. And of course, there is a premium placed on all of these,? he says.

MIEA deputy president Siva Shanker believes that investing in high-end condominiums is a great form of investment ? if you have the money.

?High-end condominiums are good investments but they?re not for everyone as they?re very expensive!?

Still, investing in high-end condominiums is still a very popular investment option for many. According to Siva, take up for Bandar Raya Developments Bhd?s (BRDB) upcoming luxury condominium project, Serai, has been quite overwhelming in just a few short months.

?There has been very low-key marketing done and by the time the advertisements came out, there were a lot of bookings,? he says, adding that over 50% of the units have already been snapped up.

Located at Bukit Bandaraya, Kuala Lumpur, Serai comprises 121 condo units located in two 21-storey towers. Sold at between RM1,300 and RM1,500 per sq ft, the units range from 4,025 to 6,913 sq ft.

There will be two penthouses of 14,000 sq ft, priced between RM19mil and RM22mil.

Serai sits on six acres, the last piece of prime real estate in the Bukit Bandaraya area. Serai will have a gross development value of about RM900mil. According to reports, a majority of the buyers were Malaysians.

?The reason take-up for Serai has been so popular is because the location where the property is being built is one of the last large parcels of land available in the area, and people don?t want to lose out.?

Siva also points out that a selling point was the fact that the project?s developer, BRDB, had a good track record.

He also cites BRDB?s One Menerung high-end condominium development, which was priced at around RM600 per sq ft half a decade ago, but is now hovering at the RM1,200 per sq ft level.

?In five short years or less, you would have doubled your money! That?s a 20% increase on returns per year, which is fantastic!?

Should you invest?

MyFP Services Sdn Bhd managing director Robert Foo says a person who wants to invest in high-end condominiums should first evaluate his wealth position before ?taking the plunge?.

?A potential investor should first consider if the investment will take up a big part of his investment. If it?s too much, then it might not be a wise thing to do.?

Age is also something to consider, says Foo, who feels that investing in high-end condominiums should be for older investors with a stable income base.

?If you?re only 25 years old, then you shouldn?t be investing in this, unless you have rich parents,? he enthuses.

Foo adds that one should definitely conduct thorough research if they want to invest in high-end condominiums.

?If the market turns on you and you can?t sell later, then you?re in trouble!?

Nixon says those looking to gain returns on high-end apartments should take a long-term view on it and not hope to make quick gains overnight.

?It?s a good investment but you should only do it for the long-haul ? perhaps have a five-year view on it.?

Demographic shift

Siva, however, points out that the increasing level of affluence has seen more Malaysians buying into high-end condominiums ? not to invest, but to occupy.

?It?s a trend that is shifting. In the past, you had Malaysians buying low-rise properties but today many are buying condominiums, especially high-end ones, in light of the fact that we are becoming more westernised and affluent.?

He also notes that many expatriates in the past that used to live in high-end condominiums in the city are now living in the suburbs.

?This is to accommodate the international schools that are now being set up in the outskirts of the city,? he says.

Mortgage Refinance Boom Still a 'Once-in-a ... - AOL Real Estate

According to the Washington, D.C.-based Mortgage Bankers Association's weekly applications survey, refinancings were up 8 percent from the first week in December and are at their highest levels since January 2009.

Overall mortgage loan application volume was up 6.2 percent, according to the MBA index, signaling a white-hot mortgage market thanks to a slightly improving economy and continued low mortgage rates.

The BankingMyWay.com Weekly Mortgage Rate tracker shows 30-year fixed mortgage rates at 3.44 percent and 15-year fixed mortgages at a rock-bottom 2.86 percent.

Adjustable-rate mortgages are at bargain basement levels. The BMW tracker has one-year ARMs at 3.20 percent and five-year ARM's at 2.53 percent.

"Continued uncertainty due to the lack of resolution regarding the fiscal cliff led interest rates lower last week, with mortgage rates reaching a new low in our survey," offers Mike Fratantoni, the MBA's vice president of research and economics.

"Refinance activity increased, with the refinance index hitting its highest level in two months, and the refinance share reaching its highest level since January 2009," he adds. "Applications for purchase increased for a fifth consecutive week, and are running almost 10 percent above their level at this time last year."

Just how excited are mortgage consumers over low rates?

The MBA says that 84 percent of all total mortgage applications are refinancings right now, with fixed-rate mortgages encompassing 97 percent of all refinancings. That's a good sign for the housing market and for the economy, as fewer people are opting for riskier adjustable-rate mortgages, which were a key negative driver in the housing market collapse of 2008 and 2009.

Mortgage rates are so low that one national mortgage lender calls the current housing market a "once-in-a-lifetime opportunity."

Plymouth Meeting, Pa.-based New Penn Financial says that you can easily snag a new home right now or refinance an existing one, even if your finances are problematic.

"It's now possible to purchase a first home or to refinance at record low mortgage rates -- even if your home has severely depreciated in value," says Bob Johnson, director of capital markets with New Penn.

Some of the interest comes from a tweak to a government-sponsored home loan program.

"The modifications made to President Obama's Home Affordable Refinance Program are another boon to many borrowers, especially those underwater on their mortgages," Johnson says. He explains that more consumers can grab a HARP loan because there is no longer a loan-to-value cap. "You can owe more than 125% of your home's worth and still be eligible," he adds.

The company reports it's seeing 30-year mortgage rates as low as 3.3 percent, and 15-year rates as low as 2.66 percent these days.

Those are ridiculously low rates, and you can make a smart financial move by locking in those low rates for the life of your home mortgage. You'll need good credit, and you'll need to shop around.

But good mortgages are low-hanging fruit going into 2013. And by all indications, it looks like things are going to stay that way.

The wildest alien planets of 2012

From massive bodies that fell just short of becoming stars to the tiniest solar systems known, 2012 has brought an array of intriguing exoplanets to light. And double-star systems that once seemed unlikely to host planets have produced a wealth of them this year.?

Here's a look at some of the most exciting alien planets discovered in 2012:

Potentially habitable worlds
In the fall of 2012, astronomers announced two new planets, discovered separately, that may have the potential to support life outside of our solar system. Both planets were found in the habitable zone of their stars, the region where a planet could hold liquid water on its surface. Water is thought to be a key ingredient in the formation of life.

HD 40307g, a "super-Earth" announced in November, is about seven times as massive as the planet we live on. The planet, which could be either rocky or a Neptune-like gas giant, sits in the middle of its habitable zone, making it possible for water to exist. [ Gallery: 7 Potentially Habitable Exoplanets ]

HD 40307g is the most distant of the six planets in its system, taking about 200 days to orbit its star. Its distance means that it isn't tidally locked, with one face perpetually turned toward its star, making it more likely to have Earth-like conditions. Because the planet is only 42 light-years away from Earth, it could potentially be imaged by telescopes in the future. Its parent star is smaller and dimmer than the sun.

Gliese 163c also lies within its star's habitable zone, although it skirts the edge. Like HD 40307g, it is about seven times the mass of Earth, and could be a large rocky planet or a smaller gas giant. The planet orbits a red dwarf that is slightly dimmer than our sun, flying around it once every 26 days. Depending on its composition, Gliese 163c could host an ocean and a dense atmosphere, or it could be too hot for life to exist.

Both planets were found using the High Accuracy Radial Velocity Planet Searcher, or HARPS, the European Southern Observatory's telescope located at the La Silla Observatory in Chile.

Two suns, four stars
A number of double-sun systems were discovered in 2012, but perhaps the most astonishing was found by amateur astronomers. The gas giant PH1 orbits a pair of stars that are part of a four-star system, the first discovery of its kind.

A close binary set of stars with masses about 1.5 and 0.41 times that of the sun, the twin stars at the core of the system dance around each other every 20 days.

Two more stars circle the pair at about a thousand times the Earth's distance to the sun.

Circling the central pair once every 138 days, PH1 is a gas giant, with a temperature ranging from 484 degrees Fahrenheit (251 degrees Celsius) to 644 F (340 C). Just bigger than Neptune, the planet could potentially host rocky moons, but such moons would also be too hot for liquid water.

PH1 was discovered by two amateur astronomers participating in the citizen scientist program Planet Hunters. A dip in the light from the system signified the potential presence of a planet, which was then confirmed by a team of professional astronomers.

In addition to being the first planet discovered by Planet Hunters, PH1 is also the first planet found orbiting a double star in a quadruple system and the first planet found in a quadruple system. [ A Galaxy Full of Alien Planets (Infographic) ]

Near-habitable Tatooine system
Scientists discovered two separate binary systems this year with planets that lay near their habitable zone. Often referred to as "Tatooine planets," due to the famous double-star-system home of Luke Skywalker in the film "Star Wars," planets orbiting a binary star system have two suns overhead. Kepler-34b and Kepler-35b are particularly notable because they lie near their stars' habitable zone.

Kepler-34b is a gas giant with almost 70 times the mass of Earth. It travels around two sunlike stars once every 289 days, staying about as far away as Earth stays from the sun. It lies 4,900 light-years from Earth.

Kepler-35b weighs in at about an eighth of Jupiter's mass. It takes 131 days to travel around its parent pair, which are both slightly smaller than the sun. The system is only 5,400 light-years from Earth.

Both systems were found using NASA's Kepler space telescope.

Tatooine twins
In another double-star system twist, two planets were found orbiting a binary pair, the first time multiple planets have been seen around twin stars. The Kepler-47 stars are 5,000 light-years from Earth. One is sunlike, while the other is smaller and fainter. They orbit each other once every 7.5 days.

Kepler-47c is a gas giant that takes 303 days to circle its suns, and rests in the habitable zone of its stars. Although it is considered unsuitable for life, its existence means that other planets could survive in the habitable zones of twin-star systems. It could also host rocky moons that have the potential for life.

Kepler-47b takes less than 50 days to orbit the pair of stars. Only three times the radius of Earth, it is the smallest known planet orbiting in a binary system. Scientists think the rocky planet may be a sweltering world with a thick atmosphere.

Closest known exoplanet
Earth's closest star system, Alpha Centauri, hosts a molten terrestrial planet, scientists found. A rocky planet orbits Alpha Centauri B, one of the three stars in the system with 90 percent the mass of the sun, once every 3.2 days. The planet passes within only a few million miles of its star, hovering at a tenth of the distance between Mercury and the sun.

Although the overheated planet likely has a scorched surface too hot for life, scientists think the system has the potential to contain other planets. Only 4.2 light-years from Earth, such planets would be easier to image with telescopes in the not-too-distant future than more faraway candidates.

Astronomers used HARPS to identify the nearby planet.

Tiniest solar system
Most of the newly discovered planets have been "super"-size: super-Earths, super-Jupiters and so on. Larger planets are generally easier to find. But three new planets only a fraction the size of Earth, including one Mars-size body, make up the smallest alien system found to date.

Smaller and dimmer than the sun, red dwarfs are the most common type of star in the Milky Way galaxy. Scientists once thought they were too small to have a sustainable habitable zone, but a separate study earlier this year showed that more could maintain planets with the potential to host life. Kepler found the planets orbiting their star KOI-961 between 0.6 to 1.5 percent of Earth's distance to the sun, tearing around the red dwarf in less than two days. The rocky bodies have temperatures ranging from 350 F (177 C) to 836 F (447 C), resulting in broiling hot surfaces unlikely to support life. The three planets have diameters 0.78, 0.73, and 0.57 times that of Earth, with the smallest being Mars-size.

A planet that's almost a star
Kappa Andromedae b, or Kappa And b, is a massive planet that came in just shy of the ability to be a star. The gas giant, which is 13 times as massive as Jupiter, fell just short of having enough mass to be classified as a brown dwarf, failed stars too low in mass to sustain fusion in their core.

Astronomers were able to take a rare direct photo of the planet using Japan's Subaru telescope at Mauna Kea in Hawaii.

The wannabe star orbits Kappa Andromedae, a star 2.5 times as massive as the sun that lies 170 light-years away. Circling the young star at almost twice Neptune's wide-reaching orbit, Kappa And b averages 2,600 F (1,400 C) and would appear bright red if seen up close.

Human Cloning Possible Within 50 Years, Nobel Prize-Winning Scientist Claims

An anonymous reader writes in with a story about the possibility of having another you in the future. "Human cloning could happen within the next half century, claims a Nobel Prize-winning scientist. Sir John Gurdon, the British developmental biologist whose research cloning frogs in the 1950s and 60s led to the later creation of Dolly the sheep in 1996, believes that human cloning could happen within the next 50 years. He said that parents who lose their children to tragic accidents might be able to clone replacements in the next few decades. Gurdon, who won this year's Nobel Prize for Physiology or Medicine, said that while any attempts to clone a human would likely raise complex ethical issues, he believes that in the near future people would overcome their concerns if cloning became medically useful."

(AP) ? Egypt's top prosecutor retracted his resignation on Thursday, a decision that could cause a new uproar in the country after he was accused of pressuring a judge not to release protesters opposed to the Islamist president.

The prosecutor, Talaat Abdullah, who was appointed by President Mohammed Morsi, told reporters he resigned on Monday "under pressure" and amid "abnormal circumstances" with prosecutors holding a sit-in in front of his office.

The protesting prosecutors accused Abdullah of pressuring a judge not to release some 130 anti-Morsi protesters taken into custody earlier this month. The judge had been investigating the Dec. 5 clashes between members of Morsi's Muslim Brotherhood group and anti-Morsi protesters ? one of the tensest moments Egypt has seen in recent weeks. At least 10 died in clashes that day.

Morsi alleged that some of those detained during the clashes had confessed they were paid to attack his supporters, a charge the investigating judge refuted.

Abdullah's appointment was part of Morsi's highly controversial Nov. 22 decrees, under which he gave himself immunity from judicial oversight. The decree was aimed at preventing the courts from disbanding the Islamist-dominated assembly drafting Egypt's new constitution, which is now being voted on in the referendum.

Morsi eventually rescinded the decrees, but only after the constituent assembly rushed in a marathon session to finalize the draft constitution. They did do despite the withdrawals of liberal representatives and Christians from the panel protesting clauses and articles they claim will turn Egypt into an Islamist state.

The decisions plunged the country into turmoil, split political forces into two camps ? Islamists and their opponents ? and sparked street protests by hundreds of thousands of the opposition and members of judiciary.

The crisis intensified when Morsi put the draft constitution to a vote, despite protests. The opposition, united under the National Salvation Front umbrella group, called for a "no" vote.

The first round drew an unexpectedly low turnout of about 32 percent and was boycotted by most judges who traditionally monitor the voting. Rights groups said there were numerous violations. Unofficial results from the first of two votes showed that 56 percent voted "yes" for the constitution. The second round of voting is set for Saturday.

In another development, an Egyptian court ordered the retrial of two policemen sentenced to seven years in prison in the killing of Khaled Said, the young man whose death helped ignite last year's uprising that ousted longtime authoritarian ruler Hosni Mubarak.

Cairo's Appeals Court overturned the prison sentences and ordered the retrial of the policemen.

Said's slaying was widely seen as Egypt's version of the case in Tunisia of Mohammed Bouazizi ? the fruit seller whose self-immolation triggered the uprising there and set off the Arab Spring in the region.

Said's family and witnesses say the two policemen savagely beat him to death after an argument at an Alexandria Internet cafe in June 2010. As proof, they point to photos of his body showing his badly disfigured and bloodied face as well as witness accounts.
